Go-Getter Drone Policies
1. Equipment Liability: Go-Getter Drone ("I," "me," "my," "we," "us," "our") maintains all equipment used during projects in good working condition. Clients are responsible for any damage caused to equipment due to their actions or negligence during the project.
2. Property Access and Flight Authorization: Clients grant access to the Remote Pilot in Command (RPIC) of Go-Getter Drone to use private or public property where the project will take place. Go-Getter Drone adheres to all applicable flight restrictions and regulations, and authorization from the Federal Aviation Administration (FAA) is obtained as necessary to ensure safe and compliant operations.
3. Safety Guidelines: Clients must follow all safety guidelines provided by Go-Getter Drone during projects, including maintaining a safe distance from the drone and refraining from interfering with its operation.
4. Image Rights: Go-Getter Drone retains ownership of all footage and images captured during the project. The client may use the footage for their own purposes, with no restrictions or permissions specified in the agreement. Go-Getter Drone reserves the right to use the footage for promotional or portfolio purposes.
5. Code of Conduct: Both parties agree to conduct themselves professionally throughout projects. This includes timely communication, respectful behavior, and prompt resolution of disputes.
6. Payment Terms: Initiation of services requires a 50% down payment, with the remaining balance due upon project completion. Failure to fulfill initial payment obligations may result in pending status for appointments. After payment completion, the project sent as a sample or result will be watermarked and provided at a lower resolution until the remaining 50% payment is received and the account balance is settled. Upon receiving the remaining payment, the high-definition project will be released without any watermark. If the product is not paid in full after project completion and the client proceeds to post or send it to a different person, legal action may be pursued for non-completion of payment while still retaining access to or failing to delete the project.
7. Termination Clause: Go-Getter Drone reserves the right to terminate projects under certain circumstances. Both parties shall fulfill any outstanding obligations and liabilities incurred up to the termination date.
8. Force Majeure: Neither party shall be liable for any delay or failure to perform obligations under this Agreement due to circumstances beyond their control.
9. Indemnification: Each party agrees to indemnify and hold harmless the other party from any claims, damages, or liabilities arising from their breach of this Agreement or negligent acts or omissions.
10. Flight Restrictions: The RPIC shall be responsible for obtaining any necessary permits or permissions for drone operation in the project area. Go-Getter Drone will adhere to all applicable flight restrictions and regulations, including restrictions on private property and restricted airspace.
11. Governing Law: This Agreement shall be governed by and construed in accordance with the laws of the State of Virginia.
12. Entire Agreement: This Agreement constitutes the entire agreement between Go-Getter Drone and clients with respect to project-related matters.
13. Confidentiality: Both parties agree to keep any sensitive information shared during the project confidential. This includes proprietary information about the client's business and any trade secrets disclosed during the planning process.
14. Safety Procedures: At Go-Getter Drone, safety is our top priority. We adhere to strict safety procedures during all drone operations to ensure the well-being of ourselves, clients, and the public. Our safety protocols include comprehensive pre-flight checks, adherence to aviation regulations, and emergency procedures in the event of unexpected situations. This service aims to provide stunning aerial imagery for portfolio and promotional purposes. It's crucial to note that this service is an offer by Go-Getter Drone, not a request. For example, if Go-Getter Drone is operating in a public area or at an event, we may choose an individual or stranger who is interested in aerial videography and photography for portfolio and promotional purposes.
